Terms of Service
These Terms are a binding agreement between you and the operator of Loka, a ProxX product (“Loka,” “we,” “us”). By creating an account, selecting “Agree and Continue,” or using Loka, you agree to these Terms, the Privacy Policy, and the Community Guidelines.
1. Eligibility and accounts
You must be at least 18, or have valid consent from a parent or legal guardian if local law permits use by a minor. You must provide accurate information, protect your credentials, and promptly tell us about unauthorized use. You may not create an account for someone else or evade a suspension.
2. Safety limitation — Loka is not an emergency service
Do not use Loka instead of police, fire, ambulance, disaster, or other emergency services. Community reports, camera feeds, maps, weather information, notifications, and automated features may be delayed, unavailable, incomplete, or wrong. Verify important information with official sources. You are responsible for your own decisions and safety.
3. License to use Loka
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use Loka for lawful, non-commercial purposes. You may not reverse engineer where prohibited, scrape, overload, bypass security, misuse APIs, impersonate others, interfere with service, or use Loka to surveil, harass, discriminate, or facilitate harm.
4. User-generated content
You retain ownership of report text, photos, videos if later enabled, and other content you submit (“User Content”). You represent that you have the necessary rights and that your content is lawful, accurate to the best of your knowledge, and compliant with our Guidelines.
You grant Loka a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt for formatting or accessibility, translate, moderate, distribute, display, and otherwise use User Content to operate, secure, improve, and promote Loka. This license ends when content is deleted except where copies remain in backups, shared safety records, legal records, or material already used with your permission.
You, not Loka, are responsible for your User Content. We do not endorse or guarantee user reports. We may review, blur, restrict, preserve, disclose, or remove content and may suspend accounts, but we are not obligated to monitor every submission. Nothing in these Terms excludes liability that cannot lawfully be excluded.
5. Copyright complaints
Do not upload content you do not have the right to use. We respond to complete copyright notices and may terminate repeat infringers. Instructions are on our Copyright page. This process is intended to support obligations under applicable Indonesian copyright law, including Law No. 28 of 2014 on Copyright.
6. Privacy, permissions, and automated features
Our Privacy Policy describes location, account identifiers, reports, photos, notifications, and service-provider processing. You control device permissions in iOS Settings. Loka currently does not train generative AI on private user uploads. Automated outputs, if introduced, may be incorrect and are not professional or emergency advice.
7. Third-party services
Maps, camera streams, weather information, links, app stores, and infrastructure may be supplied by third parties. Their terms apply to their services. Loka does not control and is not responsible for third-party availability, accuracy, content, or practices.
8. Closed beta, TestFlight, and Premium
Access during Loka’s closed beta and TestFlight period is promotional and may be revoked. Invited testers, including Wave 1 and Wave 2, receive the same Premium feature set for testing while the beta is open. This testing access is temporary.
Wave 2 tester access does not include Premium for life after public launch. When we turn on a paywall at public launch, Wave 2 accounts become the free (standard) tier unless the account holder buys Premium.
Lifetime Premium is granted only to eligible Founding Members (#1–#10), including Founder #1 and Co-founder #2, as stated on the waitlist and in the in-app founding gift. That gift is unchanged.
Beta features may change or be withdrawn at any time. Paid subscriptions, if offered later, will show pricing, billing period, and renewal terms before you confirm a purchase.
9. Enforcement and termination
We may investigate violations and remove content, limit features, suspend, or terminate access when reasonably necessary for safety, legal compliance, security, or enforcement. You may stop using Loka and delete your account in Settings. Provisions that by nature should survive will survive termination.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, Loka is provided “as is” and “as available,” without warranties of uninterrupted availability, accuracy, fitness, merchantability, or non-infringement. To the maximum extent permitted by law, Loka and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits or data, or harm caused by reliance on user reports or third-party information. Our aggregate liability for claims relating to the service will not exceed the greater of amounts you paid Loka in the prior 12 months or IDR 1,500,000. Mandatory consumer rights and liabilities that cannot be limited remain unaffected.
11. Indemnity
To the extent permitted by law, you will defend and indemnify Loka and its operators from third-party claims arising from your unlawful use, User Content, or material breach of these Terms. This does not apply where the claim was caused by Loka’s own unlawful conduct.
12. Disputes, arbitration, and class waiver
Please read this section carefully. Before filing a claim, each party will send written notice and try in good faith to resolve the dispute for 30 days. Notices to Loka must be emailed to support@lokabyproxx.com with “Legal Dispute” in the subject.
Except for claims eligible for a small-claims forum and requests for urgent injunctive relief involving safety, security, confidentiality, or intellectual property, disputes will be finally resolved by individual arbitration administered by the Indonesian National Board of Arbitration (BANI) under its then-current rules. The seat will be Jakarta, Indonesia; one arbitrator will preside; and proceedings may be conducted in Indonesian or English as the arbitrator directs. Indonesian law governs, without regard to conflict-of-law principles.
Claims must be brought individually, not as a class, collective, consolidated, or representative action, to the extent the waiver is lawful. You may opt out of arbitration by emailing the address above with “Arbitration Opt-Out,” your account email, and a clear statement that you opt out, within 30 days after first accepting these Terms. If mandatory law in your country gives you a non-waivable court or consumer remedy, that law controls.
13. Changes and electronic notices
We may change Loka or these Terms. We will provide reasonable notice of material changes and may require renewed acceptance. You consent to electronic records and notices through the app, website, or your account email. Continued use after the effective date constitutes acceptance where permitted by law.
14. General
These Terms and incorporated documents are the entire agreement about Loka. Loka is intended to operate consistently with applicable Indonesian requirements, including personal-data protection, electronic systems and transactions, consumer protection, copyright, and platform registration obligations. If one provision is unenforceable, the rest remains effective and the provision will be narrowed where permitted. Our failure to enforce a term is not a waiver. You may not assign these Terms without consent; we may assign them in connection with a restructuring, financing, merger, or sale.
